These Terms and Conditions govern the provision of painting and decorating services by Harry Stamp Painting & Decorating (“we”, “us”, or “the Contractor”) to our clients (“you” or “the Client”). By accepting a quote or engaging our services, you agree to be bound by these terms.

1. Quotes and Acceptance

All quotes provided by Harry Stamp Painting & Decorating are free of charge and valid for 30 days from the date of issue, unless otherwise stated. Quotes are based on the scope of work described at the time of inspection and are subject to change if the scope changes.
A quote becomes a binding agreement when accepted in writing (including by email or text message) by the Client. Verbal acceptance may also be considered binding at our discretion.

2. Scope of Work

The scope of work is as described in the written quote. Any additional work requested by the Client that falls outside the original scope will be subject to a variation, which will be quoted separately and must be agreed upon in writing before the additional work commences.
We reserve the right to decline additional work requests that are not reasonably related to the original scope or that cannot be accommodated within the agreed timeframe.

3. Payment Terms

Payment terms will be specified in the quote. Unless otherwise agreed, payment is due within 7 days of the completion of work and the issue of an invoice. For larger projects, a deposit or progress payments may be required, as specified in the quote.
We accept payment by bank transfer. Details will be provided on the invoice. Late payments may incur an interest charge of 2% per month on the outstanding balance.

4. Client Responsibilities

The Client is responsible for ensuring that the work area is accessible and reasonably clear of personal belongings, furniture, and other items prior to the commencement of work. Where the Client has not cleared the area, we may charge additional time for doing so.
The Client is responsible for ensuring that all necessary consents, permissions, and approvals (including from body corporates or landlords where applicable) have been obtained prior to work commencing.

5. Workmanship Guarantee

We provide a workmanship guarantee of up to five years on all work completed by Harry Stamp Painting & Decorating. This guarantee covers defects in workmanship, including peeling, flaking, or blistering paint that is attributable to our application methods.
The guarantee does not cover damage caused by normal wear and tear, physical damage, moisture ingress, structural movement, or the use of products supplied by the Client. The guarantee is also conditional on the Client having maintained the painted surfaces in accordance with the paint manufacturer’s recommendations.
To make a claim under the guarantee, please contact us in writing within the guarantee period. We will inspect the work and, if the claim is valid, carry out remedial work at no charge.

6. Insurance

Harry Stamp Painting & Decorating holds current public liability insurance. Details of our insurance coverage are available on request. We are not responsible for pre-existing damage to surfaces or structures that is not related to our work.

7. Health and Safety

We comply with all applicable health and safety legislation, including the Health and Safety at Work Act 2015. The Client agrees to maintain a safe working environment and to inform us of any known hazards on the property prior to work commencing.

8. Cancellation

If the Client wishes to cancel a confirmed booking, we require a minimum of 48 hours’ notice. Cancellations with less than 48 hours’ notice may incur a cancellation fee to cover any costs already incurred, including materials ordered specifically for the project.

9. Dispute Resolution

In the event of a dispute, we encourage the Client to contact us in the first instance to attempt to resolve the matter informally. If the dispute cannot be resolved informally, the parties agree to engage in mediation before pursuing any other legal remedy.

10. Governing Law

These Terms and Conditions are governed by the laws of New Zealand. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the New Zealand courts.

11. Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. The current version will always be available on our website. Continued engagement of our services following any changes constitutes acceptance of the updated terms.
